Terms and Conditions

WHAT THESE TERMS COVER

These Terms & Conditions apply to artwork purchased from Amy Rhodes Art, including original paintings, artwork on paper, prints and commissioned artwork.

In these terms, "you" and "your" refer to the customer, and "we", "us" and "our" refer to Amy Rhodes Art.

By placing an order with us, you agree to these Terms & Conditions.

PERSONAL DETAILS

When placing an order, you must provide accurate and up-to-date information, including your name, address, email address and any other information needed to process your order.

OUR CONTRACT WITH YOU

When you place an order through the website, you will receive an email confirming your order and the details of your purchase.

Your order is accepted when we confirm that your artwork has been dispatched.

All artwork is subject to availability, If we are unable to accept your order, we will contact you as soon as possible and provide a full refund of any payment you have made.

PRICES AND PAYMENT

All prices displayed on the website are in pounds sterling. Delivery charges are shown separately at checkout.

We take reasonable care to ensure that prices displayed on the website are accurate. If we discover an error in the price of an artwork you have ordered, we will contact you as soon as possible and give you the option to proceed at the correct price or cancel your order for a full refund.

Payment must be received or authorised before artwork is dispatched.

ARTWORK APPEARANCE

We make every effort to photograph and display artwork as accurately as possible. However, colours, textures and finishes may appear slightly different depending on your screen, device and settings. Slight variations in texture, brushwork and finish are part of the nature of an original painting and are not considered defects.

DELIVERY

We offer shipping throughout the UK and to selected international destinations. If your country is not available at checkout, please contact us to discuss delivery options.

We will aim to dispatch your artwork as soon as reasonably possible. If you need your artwork by a particular date, please get in touch before placing your order and we will do our best to accommodate your request.

Please make sure that the delivery address you provide is correct. We cannot be responsible for delays or additional costs caused by incorrect or incomplete address information supplied by you.

Risk in the artwork remains with us until the artwork comes into your physical possession.

INTERNATIONAL ORDERS

For international orders, you may be responsible for import taxes, VAT, customs duties or handling fees charged by the destination country, please do check this before you order. These charges are not included in the artwork price or shipping cost.

If an international parcel is refused because applicable customs charges have not been paid, any return delivery costs or other charges incurred may be deducted from any refund.

RETURNS

For artwork purchased online, you have 14 days from the day after receiving your artwork to let us know that you wish to cancel your purchase. Once you have notified us, you have a further 14 days to return the artwork.

We will refund the purchase price of the returned artwork and, where applicable, the cost of standard delivery originally paid.

The artwork must be returned in the same condition in which it was received and should be securely and appropriately packaged.

Please keep the original packaging until you are sure you wish to keep your artwork as this is usually the safest way to return it.

We will process your refund within 14 days of receiving the returned artwork, or receiving proof that it has been sent back.

HOW TO REQUEST A RETURN

To request a return, please email amyrhodesart@gmail.com or use the contact form on the website. Please include your order details and let us know that you wish to cancel and return your purchase.

DAMAGED, FAULTY OR INCORRECT ARTWORK

Please check your artwork on delivery and contact us within 48 hours if it arrives damaged, faulty or is not the artwork you ordered.

Please provide photographs of the artwork and its packaging so that we can assess the issue and help resolve it as quickly as possible.

CANCELLING AN ORDER BEFORE DISPATCH

If you change your mind before your artwork has been dispatched, please contact us as soon as possible.

Where we are able to cancel the order before dispatch, we will provide a full refund.

Once artwork has been dispatched, the returns process above will apply.

COMMISSIONS

Once we have discussed your ideas and agreed the details of your commission, a 30% deposit is required.

The remaining 70% balance is due once the artwork is complete and before delivery or collection.

The artwork will not be dispatched or released for collection until the full balance has been received.

CANCELLING A COMMISSION

If you decide that you no longer wish to proceed with your commission, please contact us as soon as possible.

If a commission is cancelled after work has begun, any refund will take into account the work already completed and reasonable costs incurred.

If, for any reason, Amy Rhodes Art needs to cancel a commission before it is completed, we will contact you as soon as possible and refund any payments relating to work that has not been completed.

COMMISSIONED ARTWORK AND RETURNS

We want you to be happy with your finished painting. If, once you receive your commission, you feel that it isn't right for you, please get in touch with us as soon as possible. We are happy to discuss returning the artwork and finding a suitable solution.

We will always do our best to make sure we have a clear understanding of your ideas before we begin painting, and progress photographs may be shared during the process so that we can make sure the painting is developing in the right direction.

COPYRIGHT

Purchasing an original artwork gives you ownership of the physical artwork but does not transfer copyright or reproduction rights.

You may display the artwork for personal use, but you may not reproduce, copy, scan or use the artwork commercially without written permission from Amy Rhodes.

Amy Rhodes may reproduce images of original artwork as prints or other products in the future.

Amy Rhodes also retains the right to photograph completed artwork and use images of it on the website, social media, in exhibitions and for promotional purposes.

If you would prefer your commission to remain private and not be used for promotional purposes, please let us know before the commission begins.

OUR RESPONSIBILITY

We will always aim to provide artwork as described and to the standard you would reasonably expect.

Nothing in these Terms & Conditions affects your statutory rights.

We are not responsible for delays or failures caused by circumstances outside our reasonable control.

CHANGES TO THESE TERMS & CONDITIONS

We may update these Terms & Conditions from time to time.

The Terms & Conditions that apply to your order will be those in place at the time you placed your order.

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.
